I'm placing a marker, for the sake of posterity: at least four, and quite possibly the necessary five, Supreme Court justices will vote to strike down the individual mandate provision of healthcare reform. Bad law -- but then, it's a bad Court.

My marker: by the time the Court could even hear that case, there will have been three total Obama appointments to that Court. Sotomayor and two more. I'll keep track.
